Laws are solutions to social problems
The Justice Alliance is seeking to form an Independent Islamic Alliance, The Ansar Alliance, with nations who are willing to work together for the mutual benefit of each member and therefore of the Muslim Ummah.
Israel Genocide destroys the façade of International Law
As western regimes choose to downplay and give carte blanche to Israeli genocide of Palestinians, what they do not realize is that Israel’s actions will be used as a precedent in future conflicts. By blindly backing Israel’s genocide in occupied Palestine, western regimes have not only obliterated
their soft power, they have also become catalysts for breaking down an already shaky international legal system. In the past, this system provided some minimal control mechanism over unruly political entities. Overall, future wars are likely to be more brutal and total, “thanks” to powers that enabled and downplayed the Israeli genocide in Palestine.
Human-centric vs Allah-centric Governing systems
Christian Theocracy (Man-made Law)
- The Priests and Rabbis make the Laws, so sovereignty belongs to the Priests and Rabbi’s.
Secular Republican government (Man-made Law)
- Biden’s threatening of the ICC for using arrest warrants is clear undermining of International Law.
- International Law is not respected by world leaders. They don’t respect their own laws. Why should we or anyone ?
- The people are the owners of sovereignty and power.
- The people have the right to make laws through parliament as a representation of the people.
- The people also elect the president as the executor and enforcer of the law either through direct or indirect elections.
- Power and sovereignty are on the same side, namely the people.
Islamic Theocracy (Divine Law)
- True equality is achieved, because no one is above the law.
- True separation of powers is achieved.
- Divine Law is the only Law which stands above the opinions of man.
- The owner of sovereignty is Allah swt, because the right to make laws belongs only to Allah swt.
- Power belongs to the people, meaning that it is the people who determine the ruler who will implement Islamic law, through Bay’at.
Islam’s comprehensive understanding of human beings
“Who believe in the Unseen, are steadfast in prayer, and spend out of what We have provided for them.” (2: 3)
Islam and Islamic psychology have given a concept of human nature which is diametrically contrastive to what has been conceived by the Western mainstream psychology. Muslim scholars explain that human nature in Islam discusses man’s position not only from the physical, social and psychological angles but from the spiritual dimension as well.
Islam views authority as a trust, to fulfil the communal obligations
“˹They are˺ those who, if established in the land by Us, would perform prayer, pay alms-tax,
encourage what is good, and forbid what is evil. And with Allah rests the outcome of all affairs.”
(22:41)
A few legal theorists (uṣūlīs), including al-Juwaynī, his father, and Abū Isḥāq al-Isfarāyīnī, are commonly cited as holding the opinion that a communal obligation has a higher religious rank than an individual obligation. In his al-Ghiyāthī, al-Juwaynī argues that fulfilling or neglecting an individual obligation benefits or harms only the responsible person, while the consequences of a communal obligation affect all Muslims.
Dar-al-Islam necessitates Independent Muslim Security
“If the land augments these two elements i.e. it rules by Islam and the security is by the security of Muslims i.e. by their authority, then it becomes a Dar al-Islam and changes from a Dar al-Kufr to a Dar al-Islam. Whereas if it loses one of the two, it does not become a Dar al-Islam … Hence all the lands of Muslims today are Dar al-Kufr because they do not rule by Islam.”
Sunnah Methodology to establish an Independent Islamic Alliance
- Gain the trust of the community by educating them about Islam and it’s superiority.
- Gain the support from the people of power
- Form an International Judicial Council
- Elect a leader for the ummah.
- Aligning the constitutions and foreign policies with the Shariah and with each member.
- Introduce an International Criminal Justice System.
- Once political solidarity is achieved, we begin working towards media, economic and military solidarity.
“And the foremost to embrace Islam of the Muhajirun and the Ansar and also those who followed them exactly.
Allah is well-pleased with them as they are well-pleased with Him. He has prepared for them gardens under which rivers flow (Paradise).”
