Muslims settled in a non-Muslim territory

- Build Mosques, appoint Imams and Judges.
- Request the Non-Muslim leadership to appoint a Muslim Judge.
Adopting the Western Laws
A Fatwa was given by the Sheikh-ul-Islam stating that it was permitted to adopt the Western laws and implement them in the courts upon the Muslims, because Islam does not prohibit their adoption. Hence, the rules of the democratic system were established as a constitution for the Islamic State, and the ruling system was considered by the majority of Muslims to be a Khilafah system, so long as the head of state was called the Khaleefah, even if the ruling systems implemented were not from the rules of Islam. Furthermore, the Western laws started to be implemented in courts of the Islamic State and these became considered as Islamic laws.
The reasons behind the Fatwa of the Sheikh-ul-Islam and other scholars, pertaining to the adoption of the democratic rules and Western laws was
attributable to three matters:
1- It had become implanted in peopleís minds at the time, and even nowadays, that it was permitted to adopt any matter which did not
contradict Islam and which was not prohibited by a Shariíah text. They used as evidence the fact that the Messenger of Allah (saw) had found
contracts dating back to the days of Jahiliyyah (ignorance) existing among people and he had approved them, and that which he did not approve of, he prohibited.
2- The Mubah (permitted) is that which carries no rebuke. Hence the absence of the rebuke is a permission. So taking a matter whose prohibition has not been mentioned would be Mubah.
3- The fact that at that time it became widespread that democracy is from Islam, for it is based on Shuraí (consultation), justice and equality. It was also based on giving the authority to the Ummah, and this is what Islam is concerned with.
This is where the flaws and the deviation occurred, because the thoughts concerning these three matters contained a fundamental error in their understanding of Islam.
- It is permitted to adopt the thoughts related to sciences, techniques and the like, provided these do not contradict Islam. As for the thoughts related to Aqeedah matters and Shariah rules, it would be forbidden to adopt any of them, except those brought to us by the Messenger of Allah (saw) whether it was from the Book of Allah (swt), or the Sunnah, or from what the Book and the Sunnah have guided to.
- The Messenger of Allah (saw) has explicitly forbidden us from taking anything other than what he brought. Muslim reported on the authority of Aisha (ra) that the Messenger of Allah (saw) said: He who introduces in our order something that is alien to it, must be rejected.
- The Messenger of Allah (saw), even in his capacity as a Messenger, never used to answer when asked about a rule which had not been
explained by the revelation. He used to wait until Allah (swt) had revealed such a rule. - The Shariíah rule is the address of the Legislator related to the actions of the servants, and the Muslims are commanded to refer in their actions to the address of the Legislator and to conduct their affairs in accordance with this address. Thus a rule should be taken on the basis of the fact that it has been brought by the Messenger of Allah (saw). Accordingly anything that is taken on other than this basis, it would not be considered a Shariah rule regardless of whether this agreed with the Shariíah rule or contradicted it and even if the same Shariíah rule were taken as it is, but not taken because the Messenger of Allah (saw) has brought it, but rather because it is beneficial and just.
- The Messenger of Allahís approval of the Kufr contracts is exclusive to him (saw), in his quality as the Messenger of Allah, as his approval is
legislation, just like his sayings and his actions. This quality is not conferred upon any other person but him (saw). Therefore, whatever the Messenger of Allah (saw) performed, said, or approved is considered as legislation and it is based on the revelation. No one apart from the Messenger of Allah (saw) has the right to legislate.
The contradiction between Islam and Democracy
- Democracy gives the sovereignty to the people and entrusts them with the whole matter. Hence, people are the supreme reference in everything.
According to the rules of democracy, people are the source of power. Thus people are the source of the legislative power, the judicial power
and the executive power. It is people who legislate, appoint the judges and establish the rulers. This is contrary to Islam which makes the
sovereignty to Shariíah and not to people. In this way the whole matter is to the Shariíah and it is the supreme reference in everything. - The leadership in the democratic system is collective and not for the individual. The power is also collective and not for the individual. The
authority, or the rule is assumed by the council of ministers meaning the cabinet. The head of state, be it a king or a president, is a nominal figure who reigns but does not rule. The body that rules and assumes the power is the cabinet. This is contrary to Islam, where the leadership is for the individual and not a collective and where the power is also for the individual and not a collective. - The state in the democratic system consists of several institutions and not one single institution. The government is one institution, that is the
executive power, and every syndicate is an independent institution with the competence of rule and power in the field for which it has been
established. For instance, the lawyers syndicate is an institution that has the power and the rule in all the issues related to the lawyers, ranging from the authorising of lawyers to practise the profession, or suspending them, or prosecuting them, and it deals with all matters related to the lawyers in terms of power and rule. Similar to this are the doctorsí syndicate, the pharmacistsí syndicate and the civil engineersí syndicate, among others. - In the democratic system, seeking peopleís opinion in ruling matters is considered an obligation. The ruler must seek peopleís opinion or the
opinion of the councils elected by the people, and he has no right to contradict people. - In the democratic system, the government is bound by the majorityís opinion in every single matter, whether this were in legislation or other
than that. However, they tend in some cases to make the majority rule binding even if this were 51%, and in other cases they tend to impose a
two thirdsí majority.
Freedom
Truth and Justice is central to any truly divine religion
“O you who have believed, obey Allāh and obey the Messenger and those in authority over you. And if you disagree among yourselves over anything then refer it back to Allāh and the Messenger if you truly believe in Allāh and the Last Day. That is better (conduct) and (leads to) the most excellent outcome.”

“O believers! Stand firm for Allah and bear true testimony. Do not let the hatred of a people lead you to injustice. Be just! That is closer to righteousness. And be mindful of Allah. Surely Allah is All-Aware of what you do.”

- The core affair is truth. Defending the truth, calling to the truth and protecting the carriers of the truth.
- Upon truth, rests justice, enjoining good and forbidding evil.
Ibn Khaldun: The circle of justice
- No justice without a state and a just government.
- No just government without the power of troops.
- No troops without a marketplace, for taxation.
- No marketplace without justice.
Democracy is the best application of Shura
a. CONSTITUTIONAL: Islamic government is essentially a “constitutional” government, where constitution represents the agreement of the governed to govern by a defined and agreed upon framework of rights and duties. For Muslims, the source of the constitution is the Qur’an, the Sunnah, and anything deemed relevant, effective, but not inconsistent with Islam. No authority, except the governed, has the right to put away (abrogate) or change such a constitution. Thus, Islamic governance can’t be an autocratic, hereditary or military rule. Such a system of governance is egalitarian in nature, and egalitarianism is one of the hallmarks of Islam. It is also widely acknowledged that the beginning of the Islamic polity in Madinah was based on a constitutional foundation and pluralistic framework involving non-Muslims as well.
b. PARTICIPATORY: An Islamic political system is participatory. From establishing the institutional structure of governance to operating it, the system is participatory. It means that the leadership and the policies will be conducted on the basis of full, gender-neutral participation of the governed through a popular electoral process. Muslims can use their creativity using the Islamic guidelines and human experience to date to institute, and continuously refine, their processes. This participatory aspect is the Islamic process of Shura (mutual consultation).
c. ACCOUNTABLE: This is an essential corollary to a constitutional/participatory system. The leadership and the holders of authority are accountable to people within an Islamic framework. Islamic framework here means that all Muslims are accountable to Allah and his divine guidance. But that is more in a theological sense. The practical accountability relates to people. Thus, the Khulafa ar-Rashidoon were both Khalifatur Rasool (representative of the Messenger) as well as Khalifatul Muslimeen (representative of the Muslims).
This point needs further examination because a key and stubborn misperception of Muslims in regard to democracy is based on the notion that in Islam sovereignty belongs to God, while in democracy it belongs to people. This is a naive and erroneous notion or interpretation. God IS the true and ultimate Sovereign, but he has bestowed a level of freedom and responsibility upon the human beings in this world. God has decided not to function as the Sovereign in this world. He has blessed humanity with revelations and his essential guidance. Muslims are to shape and conduct their lives, individually and collectively, according to that guidance. But even though essentially this guidance is based on divine revelation, its interpretation and implementation are human.
God IS the sovereign from the viewpoint of Islamic reality, but not from practical standpoint. When our decisions are to be made based on Ijtihad (and we could be wrong), where our constitution and policies would be formulated through human consultation (and we can err), when our judicial system would be guided by the revealed guidance, yet, based on the evidence presented, there would be chance for an innocent to get convicted and a guilty to go free, God is not acting as a sovereign in this world. To think like that is not to show due and full respect to the very freedom and responsibility that God has entrusted us with.
Thus, based on the above core features, it is important to recognize that Islam is incompatible with monarchy, military rule, dictatorship, or any other type of authoritarian political system. Islam envisions a constitutional, participatory, and accountable system of governance. This is the Islamic concept of Khilafat. However, we need to be less concerned about terminology, label or semantics than substance.
Jihad to free man from human institutions
Jihad or war for the realization of the righteous, society ordained by God as a liberating force, not as an oppression. It is not aimed at rule, control or booty. In other words jihad or Islamic war is to free man from subservience to human institutions, forces, and attitudes that are destructive of the human being and the community.
A civilized society is a religious society
Islamic Civilization is the true noble civilization that emphasizes human values and morals, intellectual and material progress. Not a civilization which may make progress in industries, economics and sciences while these morals and humanities are suppressed, but one in which the dignity and honor of man are respected according to what God has prescribed:
1. The worship of God alone.
2. The foundation of human relationships on the belief in the unity of God.
3. The supremacy of the humanity of man over material things.
4. the development of human values and the control of animalistic desires.
5. Respect for the family.
6. The assumption of the vicegerency of God on earth according to His guidance and instruction.
7. The Implementation of the Shariah.
Christian Theocracy (Man-made Law)
- The Priests and Rabbis make the Laws, so sovereignty belongs to the Priests and Rabbi’s.
Secular Republican government (Man-made Law)
- Biden’s threatening of the ICC for using arrest warrants is clear undermining of International Law.
- International Law is not respected by world leaders. They don’t respect their own laws. Why should we or anyone ?
- The people are the owners of sovereignty and power.
- The people have the right to make laws through parliament as a representation of the people.
- The people also elect the president as the executor and enforcer of the law either through direct or indirect elections.
- Power and sovereignty are on the same side, namely the people.
- They preach secularism, but they don’t believe in equal rights under the Law.
- They don’t believe that the Law applies to everyone, except to the Europeans.
Islamic Theocracy (Divine Law)
- True equality is achieved, because no one is above the law.
- True separation of powers is achieved.
- Divine Law is the only Law which stands above the opinions of man.
- The owner of sovereignty is Allah SWT, because the right to make laws belongs only to Allah swt.
- Power belongs to the people, meaning that it is the people who determine the ruler who will implement Islamic law, through Bay’at.
To vote with the wrong mindset is kufr
In the spectrum of rulings, the one extreme will be to vote with the intention that the democratic system would be of greatest benefit to mankind and believing such to be a solution to mankind’s problems. This view is due to being brainwashed with liberalism and having doubts regarding the divine system. Many feminists and modernists spend their lives with this mindset. We have seen a host of modernists flee from Afghanistan, some even grabbing onto planes that had already started its run on the runway, merely to escape the Islamic system and to flee towards the democracies which they hold dear. To vote with this mindset is Kufr, as it equates to rejecting Divine ordinance and preferring the ruling of man.
Shariah means freedom from corrupt and ever-changing; laws, moral codes and principles
(Muhammad), tell them, “Bring a Book if you are able to, from God better in its guidance than the Torah and the Quran; I shall follow it.” But if they answer you not (i.e. do not believe in your doctrine of Islamic Monotheism, nor follow you), then know that they only follow their own lusts. And who is more astray than one who follows his own lusts, without guidance from Allah? Verily! Allah guides not the people who are Zalimun. (wrong-doers, disobedient to Allah, and polytheists).

The real message of Islam is to release mankind from servitude of one man to another. Only under the Islamic Government, would people have complete freedom and real protection for their life, their dignity and wealth. Inevitably for Islam to rule, is to introduce to humanity an ideal society such as is dreamed of by Communism, Socialism and Christianity.
Is voting an exercise in futility?
According to many non-Muslim experts on the farce of democracy, elections are merely theater, and the puppeteers who are in reality in power decide beforehand who (or which two parties) will be in power and use and manipulate voting as a ploy to give the masses the impression of control and “having a say.” That is why, in almost every single democratic country around the world, two parties, each with a different “flavour,” are usually chosen as competitors. But both will ultimately further the very same satanic agendas, e.g., the supposedly muslim-friendly Obama was responsible for more wars and many more deaths of Muslims around the world than the openly racist Trump.
Most leaders in the world are pimps of the World Economic Forum
In reality, all democracies are autocracies headed by a hidden Leader. If any president or prime minister turns rogue and fails to toe the line, he will very soon be replaced, often brutally, by the World Economic Forum. Have a look at the education system in our country, and it’s towing the line of the LGBT agenda. Despite various religious and ethnic groups canvassing against such, the kingpins have given the directive, thus no amount of voices or pressure shall be able to change the course of such.
The laws themselves, which protect such immodesty and faahisha (immorality), attest to this. There could not be greater proof than the COVID scamdemic for the existence of such a World Economic Forum. Every single country in the world rolled out and imposed the very same satanic and even moronic policies on the masses. The only two presidents (of Tanzania and Burundi) from the 200~ countries who failed to coorporate adequately with the evil scam were replaced very swiftly, both dying in mysterious circumstances.
